Doanh nghiệp ngoài Nhà nước gồm các doanh nghiệp vốn trong nước, mà nguồn vốn thuộc sở hữu tập thể, tư nhân một người hoặc nhóm người hoặc có sở hữu Nhà nước nhưng chiếm từ 50% vốn điều lệ trở xuống. Khu vực doanh nghiệp ngoài Nhà nước gồm: (1) Các hợp tác xã; (2) Các doanh nghiệp tư nhân; (3) Các công ty hợp danh; (4) Các công ty trách nhiệm hữu hạn tư nhân; (5) Các công ty cổ phần không có vốn Nhà nước; (6) Các công ty cổ phần có tỷ lệ vốn Nhà nước từ 50% vốn điều lệ trở xuống. Khu vực có vốn đầu tư trực tiếp của nước ngoài gồm các doanh nghiệp có vốn đầu tư trực tiếp của nước ngoài, không phân biệt tỷ lệ vốn của bên nước ngoài góp là bao nhiêu. Khu vực này có hai loại hình chủ yếu là doanh nghiệp 100% vốn nước ngoài và doanh nghiệp liên doanh giữa nước ngoài với các đối tác trong nước. Doanh thu thuần của doanh nghiệp là tổng thu nhập của doanh nghiệp do tiêu thụ sản phẩm, hàng hoá, cung cấp các dịch vụ cho bên ngoài sau khi trừ các khoản thuế (thuế tiêu thụ đặc biệt, thuế xuất khẩu, thuế giá trị gia tăng theo phương pháp trực tiếp phải nộp) và trừ các khoản giảm trừ (chiết khấu, giảm giá hàng bán, hàng bán bị trả lại). Doanh thu thuần không bao gồm: (1) Doanh thu hoạt động tài chính (trừ cho thuê thiết bị, máy móc có người điều khiển kèm theo); (2) Doanh thu các hoạt động bất thường: Thanh lý, nhượng bán tài sản, thu tiền phạt vi phạm hợp đồng, thu các khoản nợ khó đòi đã xử lý... Lao động của doanh nghiệp là toàn bộ số lao động do doanh nghiệp quản lý, sử dụng và trả lương, trả công. Lao động của doanh nghiệp không bao gồm: (1) Những người nhận vật liệu của doanh nghiệp về làm tại gia đình họ (lao động gia đình); (2) Những người đang trong thời gian học nghề của các trường, trung tâm gửi đến thực tập mà doanh nghiệp không quản lý và trả lương; (3) Những lao động của các liên doanh gửi đến mà doanh nghiệp không quản lý và trả lương. Đối với các doanh nghiệp tư nhân thì những người là thành viên trong gia đình có tham gia quản lý sản xuất hoặc trực tiếp sản xuất, nhưng không nhận tiền lương, tiền công - thu nhập của họ là thu nhập hỗn hợp, bao gồm cả lãi kinh doanh - cũng được tính là lao động của doanh nghiệp. Cơ sở sản xuất kinh doanh cá thể là cơ sở kinh tế diễn ra hoạt động sản xuất kinh doanh thường xuyên thuộc tất cả các ngành kinh tế phi nông, lâm nghiệp và thủy sản, có địa điểm xác định và có ít nhất là 1 lao động chuyên nghiệp thực hiện hoạt động kinh tế tại điểm đó. Explanation of terminology, CONTENT of some statistical Indicators on enterprise and individual business establishment Enterprises are economic units that independently keep business account and acquire its own legal status. Thay may be set up by State Enterprise Law, Cooperative Law, Enterprise Law, Foreign Investment Law or by Agreement between The Government of Viet Nam and Government of Foreign Countries. There are following types of enterprise: (1) State owned enterprises at central level and at local level (including also enterprises which are under controlling of the Party and organizations and their capital is provided by the government). (2) Collective enterprises set up by Cooperative Law. (3) Private enterprises. (4) Collective name companies. (5) Limited companies. (6) Joint-stock companies (including also state owned enterprises which were privatized and companies which had capital share of the government). (7) Enterprises with 100% foreign capital, foreign joint venture enterprises set up by Foreign Investment Law. Number of enterprises and statistical indicators of enterprises are only counted for enterprises, which are still operating by 31 December every year, excluded following enterprises: (1) Enterprises that received business license, tax codes but still do not operate; (2) Enterprises that were dissolved, jointed to other enterprises or changed type of business activity; Enterprises that got operation permission but do not locate in local area (searching, but not found); (3) Economic units that do not independently keep business account such as branches, dependent economic units and other non-economic bodies. State owned enterprises include following types: (1) Enterprises with 100% of state capital operating according to enterprise law and under control of central or local governmental agencies; (2) Limited companies under management of central or local government; (3) Joint stock companies with domestic capital, of which the government shares more than 50% charter capital. Non-State enterprises are enterprises set up by domestic capital. The capital may be owned by cooperative, private with 1 or individual group or the government when capital of the government is equal or less than 50% of registered capital. There are following types of non state enterprises: (1) Cooperatives; (2) Private enterprises; (3) Cooperative name companies; (4) Private limited companies; (5) Joint stock companies without capital of State (6) Joint stock companies with 50% and less than of charter capital shared by the government. Foreign direct invested enterprises are enterprises with capital directly invested by foreigners, not separated by percent of capital shared. There are following types of foreign direct invested enterprise: Enterprises with 100% of capital invested by foreigners and Joint venture enterprise between domestic investor and foreigner. Net turnover of enterprise is total income of enterprise gained by selling its products or services after subtracting taxes (special selling tax, export tax, value added tax by method of payable direct) and other reduction (discounting, reducing selling price, returning goods). Net turnover does not include: (1) Turnover gaining by financial activity (except lending asset with its controller); (2) Turnover gaining by special activity such as: selling off asset, getting money due to partner violates contract, getting money from bad debt that was processed... Employees of enterprise are total of persons enterprise uses and pays wage or salary. Employees of enterprise do not include: (1) Persons who receive material of the enterprise to produce goods at their home (household employees); (2) Persons who are working as apprentices sent from schools, training center for practice and enterprise does not pay salary; (3) Persons who are sent to enterprise to work by joint venture of other enterprises and the enterprise does not pay salary. Concerning private enterprises, member of the proprietor's households who participates in management or directly working for the enterprise but does not get salary or wage - their income is mixed with the profit of business - they are also considered as employees of the enterprise.
