Origin of law: Not much influenced by Roman law
Formed and developed on the basis of British civil law, which respects
precedent. The Anglo-American legal system
was less influenced by
Roman law because the complexity and rigor in the traditional proceedings
of English law prevented the reception of Roman law into British territory.
Main Source of law: case law/ precedent ( law developed by judges through
case law).
The main legal source of the Anglo-American legal system is case
precedent, most legal institutions and regulations are formed not by the
promulgation of legal documents but by case precedents.

Judgments in high courts are generally considered
precedent and are
binding on local courts.
Currently, although legal documents in these countries are also
promulgated quite a lot, judges still rely on both case law,
legal documents
and actual grounds to adjudicate.
When British judges have found a case with similar circumstances, they
will look for the legal principle that the previous judges invented to dealt with
and apply to the present case.
Inductive reasoning: the life of the law has not been logic. it has been
experience. The judgements rendered by the superior
court are generally
binding on the lower court in the course of hearing the present cases.
Main law-making bodies: Role of judiciary – create the law
Legal Procedure: Adversarial trial (judges acts as arbitrator)
In the Anglo-American legal system, the principle of litigation is widely
applied in the proceedings.
During
the proceedings, the parties (the plaintiff and the defendant; the
prosecutor and the medical party...) always have arguments, battles and
evidence with each other, and the judge only plays the role of a person. The
arbitrator listens to the opinions of the parties and makes an award.
Because of the widespread use of judgment, in
most cases the judge of a
judge of the supreme court is both the adjudicator and the creator of the
law, indirectly.
Some specific institutions: writ (trác hầu tòa), trust (ủy thác). Trust regulation
was born in association with the need to settle land disputes arising from trust
contracts in order to provide a fair solution.
